The article explores the challenges of ensuring voluntary and informed consent which is obtained from potential research subjects in the north‐eastern part of Romania. This study is one of the first empirical papers of this nature in Romania. The study used a quantitative survey design using the adapted Quality of Informed Consent (QuIC) questionnaire. The target population consisted of 100 adult persons who voluntarily enrolled in clinical trials. The informed consent form must contain details regarding the potential risks and benefits, (...) the aim of the clinical trial, study design, confidentiality, insurance and contact details in case of additional questions. Our study confirmed that although all required information was included in the ICF, few clinical trial participants truly understood it. We also found that the most important predictive factor for a good subjective and objective understanding of the clinical trial was the level of education. Our study suggests that researchers should consider putting more effort in order to help clinical trials participants achieve a better understanding of the informed consent. In this way they will ensure that participants’ decision‐making is meaningful and that their interests are protected. (shrink)

In recent decades scholars have acknowledged that transactions in the informal economy have not vanished with modernization and industrialization as expected but rather remain an important contemporary aspect of overall production and consumption across the world, in both developing and developed countries. Yet little is known about the profile of the consumers in this realm or what drives them to purchase from the informal economy. A systematic review of the literature investigating consumption in the informal economy reveals a severely underdeveloped (...) area of consumer studies with significant gaps in terms of its theoretical approaches, methods and regional coverage. The findings of the existing literature is that multiple motives are used by consumers for justifying their purchases in the informal economy beyond the dominant simplistic view that they do simply for financial gain or for a lower price. The outcome is a recognition that responsibility to reducing this phenomenon with negative effects on governments, businesses, workers and consumers lies not just with public authorities but also practitioners who need to correct the failures in formal market provision. The significant gaps identified in the literature are then used to highlight a comprehensive future research agenda, which includes the need for the development of an institutionalist theoretical perspective when explaining consumers‘ participation in the informal economy and social marketing interventions. Work on advice has concentrated on institutional settings where there are restrictions on roles, actions and their organisation. This article focuses on advice giving in mundane settings: interactions between mothers and their young-adult daughters in a corpus of 51 telephone calls. Analysis reveals a range of designs that can be ‘advice implicative’ including advice-implicative interrogatives and advice-implicative assessments. Recipients orient to the characteristic features these implicit forms share with more explicit advice: normative pressure on the recipient’s conduct and epistemic asymmetry (...) between advisor and advisee. Advice-implicative actions orient to contingencies on the recipient’s ability or willingness to perform the target action. They also display varying degrees of entitlement over the recipient’s performance of the target action. Manipulating contingency and entitlement can soften or heighten both the normative thrust and the knowledge asymmetry of the advice giving. This analysis further discusses the distinction between the practices of advising, directing and requesting, and allows consideration of how action design connects to relationality between parties. Natural languages contain many layers of sequential structure, from the distribution of phonemes within words to the distribution of phrases within utterances. However, most research modeling language acquisition using artificial languages has focused on only one type of distributional structure at a time. In two experiments, we investigated adult learning of an artificial language that contains dependencies between both adjacent and non-adjacent words. We found that learners rapidly acquired both types of regularities and that the strength of the adjacent statistics (...) influenced learning of both adjacent and non-adjacent dependencies. Additionally, though accuracy was similar for both types of structure, participants’ knowledge of the deterministic non-adjacent dependencies was more explicit than their knowledge of the probabilistic adjacent dependencies. This article defends the idea of applying principles of corrective justice to the matter of climate change. In particular, it argues against the excusable ignorance objection, which holds that historical emissions produced at a time when our knowledge of climate change was insufficient ought to be removed from the equation when applying rectificatory principles to this context. In constructing my argument, I rely on a particular interpretation of rectificatory justice and outcome responsibility. I also address the individualism objection by showing (...) why we should view states as relevant agents of climate change. This argument is built on the assumption that states are institutions set up to coordinate and regulate human interaction, so as to protect their citizens from the unwanted consequences of such interaction. Patterns of memory sharing begin early in one’s life, informing relationships, one’s history, and one’s sense of cultural belonging. Memory sharing among families has been the focus of research investigating the relationship between mental health and intergenerational memory. A burgeoning body of research is showing that intergenerational knowledge of one’s family history is associated with positive mental health and wellbeing. However, research on the specific mechanisms and potential applications of such findings are just beginning to emerge. In particular, studies examining (...) intergenerational storytelling point to the importance of culture and gender as critical factors underlying how stories are told and the extent to which these stories are associated with wellbeing. Such findings hold important promise for the pentation and treatment of mental health issues. As research in this area continues to evolve, the identification and characterization of factors and mechanisms underlying intergenerational family stories and wellbeing may help to guide the integration of family stories into mental health interventions. Open-ended interviews remain the default data generation technique for qualitative psychology and sociology. This commentary raises questions with Griffin's understanding of naturalistic materials and the emic/ etic distinction. It reiterates problems in the use of open-ended interviews, and repeats the case for more considered support for their use.

The affect heuristic and implicit attitudes are two separate concepts that have arisen within different literatures but that have a number of similarities. This paper compares these two constructs with the aim of clarifying exactly what they are and how these relate to one another. By comparing and contrasting the affect heuristic and implicit attitudes we conclude that the “affect pool” of images tagged with feelings referred to within the affect heuristic literature may be equivalent to the construct of implicit (...) attitudes. Further to this, the affect heuristic itself could be considered as a specific subtype of spontaneous process that is driven by implicit attitudes. We propose that each of the implicit attitude and affect heuristic constructs could be further developed through the examination and comparison of existing literatures surrounding the other. Teeth are one of the most fascinating innovations of vertebrates. Their diversity of shape, size, location, and number in vertebrates is astonishing. If the molecular mechanisms underlying the morphogenesis of individual teeth are now relatively well understood, thanks to the detailed experimental work that has been performed in model organisms (mainly mouse and zebrafish), the mechanisms that control the organization of the dentition are still a mystery. Mammals display simplified dentitions when compared to other vertebrates with only a single tooth (...) row positioned in the anterior part of the mouth, whereas other vertebrates exhibit tooth rows in many locations. As proposed 60 years ago, tooth rows can be formed sequentially from an initiator tooth. Recent results in zebrafish have now largely confirmed this hypothesis. Here this observation is generalized upon and it is suggested that in most vertebrates tooth rows could form sequentially from a single initiator tooth. (shrink)

Models of culture and action argue that crises can be generative of change, with changing contexts setting off reflexivity—a view of crisis as self-evident that is echoed in comparative historical work. Looking to the beginning of the Cold War in Romania and France, this article elaborates two instances when crises did not produce reflexive recognition. This echoes performative approaches that highlight actors needing to interpret crises into being yet underscores that crisis claims nonetheless take place in contexts potentially marked by (...) shifting sociocultural scaffoldings. Rooted in the empirical finding that actors can live through—and be affected by—structural transformations without thinking of themselves as being in crisis, I put forward a conception of crises as unclear as they are taking place. Actors can guess at being or not being in crisis, with no guarantee their guess is fortuitous. Crisis management will be the result of these guesses: some informed, some lucky—and some, indeed, disastrous. (shrink)

Am Beispiel des Kohlenbergbaus in der Zwischenkriegszeit rekonstruiert er, wie zuerst Sozialpolitiker den „Preßluftschaden“ als Berufskrankheit definierten, woraufhin Unfallchirurgen diesem sozialrechtlichen Tatbestand eine ärztliche Praxis abgewinnen mussten. Auf Grundlage medizinischer Fachpublikationen und der Archivalien des höchsten Spruchgremiums im Sozialrecht, des Reichsversicherungsamtes, wird die kontroverse Hervorbringung von neuem Wissen nachgezeichnet. Der Beitrag argumentiert, dass medizinisches Wissen in der Begutachtung weder einfach „angewandt“ noch (...) dass es kompromittiert wurde, wenn sich Ärzte an den Rationalitäten von Verwaltung und Rechtsprechung orientierten. Medizinische Begutachtung sollte stattdessen als eine spezifische Form des ärztlichen Wissens verstanden werden. (shrink)

Using the concept of postmemory—coined by Mariane Hirsch—this paper explores the role of photographs in recalling past trauma in two families who participated in the anticommunist armed resistance in Romania. Members of these families were executed and the survivors had to endure further persecution. The interviews revealed that some pictures offer the frame for remembering suppressed memories. The images have peculiar meanings for different generations of the same family. For the participants in this study, seeing the photographs equates to reliving (...) a past trauma and giving a new meaning to it. Pictures function as realms of encounter and reconciliation between present and past generations of the same family. The first outcome of the process is memory recovery; in this, people also recover their identity and the result is transgenerational healing. Some of the interviews discussed in this paper were done with members of my family. (shrink)

This essay examines Jacques Rancière’s concept of subjectivation, the coming into being of a political subject as the substance of radical democratic politics. In particular, it provides a detailed reading of disidentification and impossible identification as they relate to figures of the Other. I present some possible points of intersection between subjectivation and hybridity, and explain why these concepts may ultimately be incompatible in their most common formulations. Examining closely a few recurring figures of alterity, I show that, in each (...) case, the Other is used principally as an abstract figure, a procedure which risks effacing historically situated political voices in the name of universalism. Moreover, I argue that decisions regarding which subjects authentically enact politics and which remain in the realm of the police can themselves turn out to be politically neutralizing. (shrink)

The paper approaches the question whether teachers should be allowed to wear headscarves by analysing the concept of liberal neutrality. After showing problems with current conceptions of neutrality, it suggests understanding neutrality as a two-fold concept: a) there are matters the state has no business getting involved in if it wants to respect its citizens as free (respect element), b) citizens ought to be treated as equals despite their different world views (fairness element). This two-fold understanding explains why there are (...) neutrality based reasons for and against allowing teachers to wear headscarves in school. The author argues that in view of the ideals of freedom, equality and respect underlying liberal neutrality the reasons for allowing headscarves prevail. (shrink)

The possibility of performing germline modifications on currently living individuals targets future generations’ health and well-being by reducing the diversity of the human gene pool. This can have two negative repercussions: reduction of heterozygosity, the latter being associated with a health or performance advantage; uniformization of the genes involved in reproductive recombination, which may lead to the health risks involved in asexual reproduction. I argue that germline interventions aimed at modifying the genomes of future people cannot be ethically justifiable if (...) there is no possibility of controlling the intervention either by reversing or altering it, whenever need demands it. This argument is challenged on six different grounds: safety, population versus individual focus, spontaneous mutations, exceptionalism, the intentional pursuit of genetic diversity through germline interventions, and harm reduction potential. The non-commutative counterpart of the well-known Łukasiewicz propositional logic is developed, in strong connection with the algebraic theory of psMV-algebras. An extension by a new unary logical connective is also considered and a stronger completeness result is proved for this system.

While the low conviction rate for cases of sexual violence is often justified by the so-called ‘he-said-she-said’ nature of these cases, the increasing presence of digital evidence has begun to challenge this justification. This digital evidence can provide new opportunities for intervening in and prosecuting sexual violence. However, it may also be used against complainants or deemed still insufficient for proving guilt. Thus, while digital evidence may be challenging typical criminal justice responses to sexual violence, it may equally be utilised (...) to buttress entrenched stereotypes and criminal justice practices that lead to complainant dissatisfaction and serve to support low conviction rates. I draw on critical feminist legal theory, feminist engagements with digital technology and sexual violence, and visual criminology to theorise the burgeoning role of the digital witness in sexual violence cases. The “Burning Bush” was the name of a cultural circle in Bucharest in the 1940s, comprised of clergy and intellectuals who met periodically to discuss theology, philosophy, literature and to learn about prayer. Some of the most significant members of this group were arrested during the second repressive wave by the Romanian communist regime (1958); along with twelve elderly monks and intellectuals, four students who kept in touch with them were also arrested. Their names were George Văsâi, Șerban Mironescu, Nicolae (...) Rădulescu, and Emanoil Mihăilescu. Using memoirs, oral history interviews and documents from the Securitate archives, the paper will address the interactions between the young students and the elder members of the Burning Bush group of clergy and intellectuals. The narratives of the informative and criminal files of the Securitate regarding the content of their meetings will also be depicted, all inside a larger context of the regime’s repressive measures and relations with the Romanian Orthodox Church. Through a multiphase coding process, the researchers examined the selection, characteristics, and planned use of 111 written, visual, oral, and material sources that preservice teachers incorporated into plans for inquiry-based elementary social studies instruction. Preservice teachers identified Google as their main tool for locating potential sources, selected far more secondary than primary sources, and varied widely in how they prepared sources for elementary students. Planned use of sources focused almost entirely on identifying key details, with limited opportunities designed for students (...) to contextualize sources, examine bias, or corroborate evidence. To describe phenomena that occur at different time scales, computational models of the brain must incorporate different levels of abstraction. At time scales of approximately 1/3 of a second, orienting movements of the body play a crucial role in cognition and form a useful computational level embodiment level,” the constraints of the physical system determine the nature of cognitive operations. The key synergy is that at time scales of about 1/3 of a second, the natural sequentiality of body movements can (...) be matched to the natural computational economies of sequential decision systems through a system of implicit reference called deictic in which pointing movements are used to bind objects in the world to cognitive programs. This target article focuses on how deictic bindings make it possible to perform natural tasks. Deictic computation provides a mechanism for representing the essential features that link external sensory data with internal cognitive programs and motor actions. One of the central features of cognition, working memory, can be related to moment-by-moment dispositions of body features such as eye movements and hand movements. (shrink)

Social advertising often employs persuasive imagery in support of a morally laden cause. These visual arguments can take the form of veridical representations of the given situation or the form of purposeful visual blends. Both visual routes to persuasion have serious ethical issues to confront. In what concerns the purportedly veridical images, controversies about picture retouching and framing have cast many doubts on their success in offering unmediated access to a given reality. Editorial interests have proven far too influential on (...) the destiny of what and how is presented to the audience from the amount of visual material available on a topic. Even when the audience is certain that photos are not doctored, the use of veridical images may be seen as unethical. Their disproportionate affective impact may lead the audience to hold biased opinions, since other concerns may be impossible to capture in a vivid picture. Visual blends may be the answer to this problem, employing the fictional or the figurative to help the viewer grasp the moral anatomy of a given situation. Their generous use of figurative meaning may be seen as their strength and their weakness at the same time. It makes them less likely to face accusations of distorting reality, because they do not claim to be windows on reality per se. At the same time, it makes them vulnerable to interpretations that miss their true point – one might appreciate the artistry of a visual metaphor or a visual pun and fail to consider the statement it makes about a given situation. Contemporary philosophical approaches to the place of visuals in moral persuasion inform my analysis of the use of visual arguments in charity-oriented advertising. (shrink)

ZusammenfassungIn der neueren deutschen Rechtsprechung wurden die Anforderungen an die rechtliche Zulässigkeit von Zwangsbehandlungen verschärft und der Berücksichtigung des natürlichen Willens nicht selbstbestimmungsfähiger Patienten ein höherer Stellenwert eingeräumt. So ist der behandelnde Arzt etwa verpflichtet, einen letzten Versuch zu unternehmen, eine auf Vertrauen gegründete Zustimmung zu erhalten. In Anbetracht dessen, dass ein solches Gespräch im Kontext informellen Zwangs stattfindet, ergibt sich ein medizinethisches Dilemma: Entweder wird eine Zwangsbehandlung durchgeführt und somit direkter körperlicher Zwang angewendet, oder eine Zustimmung wird erzielt, jedoch (...) gegebenenfalls um den Preis, dass informeller Zwang – z. B. in Form einer Drohung, Täuschung oder Manipulation – ausgeübt wird. Es wird dafür argumentiert, dass die Antwort auf dieses Problem im philosophischen Begriff der Anerkennung zu finden ist, der im vorliegenden Kontext als eine spezifische Haltung aufgefasst wird und sich in einem respektvollen Umgang des Klinikpersonals mit den betroffenen Patienten zeigt. Die Ausübung von Zwang ist in solchen Fällen kaum zu vermeiden. Dennoch kann man in dieser Situation besser oder schlechter mit dem Patienten umgehen – und besser heißt hier, dem Patienten Anerkennung entgegenbringen. (shrink)

This article tackles ethical and political dimensions of emotions while exploring forms of solidarity among women exposed to gender violence. Taking the case of a multi-ethnic neighbourhood in the border city of Giurgiu, Romania, the author investigates the role of shame, guilt and security in decisions about managing the experience of abuse in intimate partner violence. In the local community, institutional and personal interactions are shaped by state and private agents who intervene in the lives of women who are victims (...) of gender-related violence. Institutional dynamics, street-level bureaucracy and community self-regulation employ emotive-political concepts and contribute to norms that justify and maintain violence against women. Building on scholarship of emotions and feminist ethical theories, the article shows the formative relation between the notions of shame, guilt and security, and points to the political subjectivities they create in a multi-ethnic community. Cet article prend comme point de départ sa théorie du récit élaborée à partir de À la recherche du temps perdu dans Discours du récit, puis dans Nouveau Discours du récit et Fiction et Diction. Si Genette part du particulier (l’œuvre de Proust) pour aller vers le général (sa théorie narratologique), je me demanderai, en allant du général vers le particulier, en quoi son analyse narrative nous permet une meilleure compréhension de (...) l’œuvre de Proust. Pour montrer comment la poétique peut devenir complémentaire de la critique, j’étudie le cas de Paul Ricœur, qui s’est lui aussi penché sur la question du temps et du récit, pour montrer comment il a intégré la théorie de Genette dans une herméneutique littéraire, en déplaçant l’accent du texte vu comme une structure vers « le monde du texte ». In Malicious Deceivers, Ioana B. Jucan traces a genealogy of post-truth intimately tied to globalizing modernity and connects the production of repeatable fakeness with capitalism and Cartesian metaphysics. Through case studies that cross times and geographies, the book unpacks the notion of fakeness through the related logics of dissimulation (deception) and simulation (performativity) as seen with software/AI, television, plastics, and the internet. Specifically, Jucan shows how these (dis)simulation machines and performative objects construct impoverished pictures of the world, ensuring a (...) repeatable sameness through processes of hollowing out embodied histories and lived experience. Through both its methodology and its subjects-objects of study, the book further seeks ways to counter the abstracting mode of thinking and the processes of voiding performed by the twinning of Cartesian metaphysics and global capitalism. Enacting a model of creative scholarship rooted in the tradition of writing as performance, Jucan, a multimedia performance-maker and theatre director, uses the embodied "I" as a framing and situating device for the book and its sites of investigation. In this way, she aims to counter the Cartesian voiding of the thinking "I" and to enact a different kind of relationship between self and world from the one posited by Descartes and replayed in much Western philosophical and - more broadly - academic writing: a relationship of separation that situates the "I" on a pedestal of abstraction that voids it of its embodied histories and fails to account for its positionality within a socio-historical context and the operations of power that define it. This manuscript examines argument engagement in close relationships. Two pilot studies were conducted to identify what factors naïve actors report matter to them when considering whether to engage in an interpersonal argument, and to develop and pre-test measurement scales for these factors. The main study examined which of these factors predicted participants’ behavioral intent to engage in an argument about different topics and with different partners. Results indicated intent to engage was predicted by five factors: one’s orientation to the topic, (...) one’s preparedness for an argument, the costs of arguing, the effort involved in arguing, and one’s right to speak one’s mind. Several of these factors are new contributions to argument engagement research. A discussion of these results and their implications are presented. (shrink)
